VAMPIRELLA CONTEST RULES & AGREEMENT

CONTEST TITLE:
Are you Vampirella? This is your chance to bring the sexy comic book icon to life!

Vampire-Con is teaming up with Harris Publications for the 40th anniversary of Vampirella, the legendary comic book heroine from Planet Drakulon www.vampirella.com. In celebration of the occasion, Vampire-Con is offering a chance to be crowned Vampirella for the weekend at Vampire-Con 09.

CONTEST WINNER:
The top three contestants will be invited to participate at the Vampire Film Festival on Saturday, August 15, 2009 at the New Beverly Cinema located at 7165 West Beverly Blvd., Los Angeles, CA 90036. The winner will be unveiled at The Music Box Theatre @ Fonda located at 6126 Hollywood Blvd., Hollywood, CA 90028 during the daytime portion of the convention on Sunday, August 16th and she will be the guest of honor at Vampirella's Ball that evening at the 21 & over danse macabre.

CONTEST PERIOD: The Contest begins on or about July 20, 2009 at 12:01 a.m. Pacific Standard Time (PST) and ends on August 3, 2009 at 11:59 pm PST (contest period).

ELIGIBILITY:
The contest is open to female legal residents of the 50 United States and the District of Columbia ages 18 and over. Employees of Harris Publications and Vampire-Con (“Sponsors”) are not eligible. Contestants must be a registered user on vampire-con.com. Semi-finalists who receive the most votes via online polling will be contacted by Vampire-Con for a telephone interview out of which three contestants will be invited to appear on Saturday, August 15th at the Vampire Film Festival at the New Beverly Cinema located at 7165 West Beverly Blvd., Los Angeles, CA 90036 as well as appear at Vampire-Con during the day, taking place on Sunday, August 16th at The Music Box Theatre @ Fonda located at 6126 Hollywood Blvd., Hollywood, CA 90028 where the winner will be named by audience applause. The winner of the Vampirella spokesmodel contest will be the guest of honor at Vampirella’s Ball on Sunday evening, August 16, 2009 at The Music Box Theatre @ Fonda in Hollywood. Final contestants are responsible for their own travel expenses.

ENTRY:
To enter, register on vampire-con.com and paste your photograph in a Vampirella costume. All entries must be actually received by no later than the end of the Contest Period in order to participate. All requested information on the registered user form must be completed to enter and to be eligible to win. Any communication, data or other information transmitted by an entrant in connection with the Contest, is and will be treated as non-confidential and non-proprietary. Judges reserve the right, in their sole and absolute discretion, to disqualify any entry that is inappropriate for any reason. The universe of potential entrants includes online entries and individuals contacted by sponsors who are judged on the same criteria as online entrants. Entries become the exclusive property of Vampire-Con and Harris Publications and will not be returned. By submitting an entry, each entrant grants and hereby irrevocably assigns (and represents and warrants that it has the right to grant and irrevocably assign) to Vampire-Con and Harris Publications all right, title, and interest in and to the entry, data and/or other information collected, photographs and/or video footage, which shall include, without limitation, the exclusive right to reproduce, publish, exhibit, perform, display, edit, modify, adapt, use, assign, transfer, create derivative works of, distribute, sell, or otherwise exploit the entry, data, or other information collected, or any part thereof, together with any other material, in any and all media whether now or hereafter known (including, without limitation, online media), for any lawful purpose, including, without limitation, all commercial purposes, in perpetuity, throughout the universe, at no charge to Vampire-Con and Harris Publications without compensation to the entrant.

GENERAL TERMS AND CONDITIONS:
By entering contest, you consent to the use of your name, likeness and biographical information, and all entry materials, for advertising and commercial purposes without further compensation or consent, unless prohibited by law. You release, discharge and hold harmless sponsors, and their respective affiliates, subsidiaries, and agents, and each of their respective officers, directors and employees, from any and all claims or damages, including personal injury and/or death, trademark infringment, violation of privacy/usage rights, and/or property damage, arising out of your participation in the contest and/or your acceptance and use and/or misuse of the prize awarded. Sponsor is not responsible for computer system, phone line, technical, hardware, software, program or server failures of any kind; lost or unavailable network connections; failed, incomplete, garbled or delayed computer transmissions; or lost, late, illegible, corrupted, misdirected, or incomplete entries. In the event of a dispute concerning the identity of an entrant, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. "authorized account holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, internet service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any attempt to damage any web site or undermine the legitimate operation of this contest may be a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to disqualify entries made by any participating individual and seek damages from any such participant to the fullest extent permitted by law. Sponsor is not responsible for corrupted entries or technical or human errors or omissions of any kind relating to the submission or processing or entries. If, for any reason whatsoever, thiscontest, in sponsor's sole opinion, is not capable of running as planned, including, but not limited to, by reason of infection by computer virus, tampering, fraud, technical failures, or any other cause which, in the sponsor's sole judgment, corrupts of affects the administration, security, fairness, integrity or proper conduct of thiscontest, sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this contestand limit entries to those submitted prior to the action taken, or proceed in such a manner as may be deemed fair and equitable by sponsor in its sole discretion. In no event will sponsor or its officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages, arising out of your access to use of the website or the downloading from and/or printing material downloaded from said site, or any other web site. Without limiting the foregoing, everything on the site is provided "as is" without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.

WINNER NOTIFICATION:
The winner will be selected from all eligible entries received throughout the Contest Period. The potential winner will be notified by telephone and/or mail and/or email using the contact information given at the time of entry. Vampire-Con shall have no liability for any winner notification that is not received by the potential winner for any reason.

GENERAL RELEASE: Acceptance as winner, constitutes winner’s permission for Promotion Entities (Vampire-Con and Harris Publications) to use winner’s name, photograph, likeness and voice for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Each entrant agrees that Vampire-Con, Harris Publications and Moondance Events & Entertainment, Inc. shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Contest or in any Contest related activity In the event of a dispute as to the identity of an entrant which cannot be resolved to Vampire-Con's satisfaction, the entry will be deemed ineligible. Vampire-Con reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website.

By entering the Contest, each entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or connected with the Contest or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the contest, but in no event will attorneys' fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out-of-pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased.

All decisions of Vampire-Con related to the Contest are final and binding, without appeal.
